1. Acceptance of Terms

These Terms of Use (“Terms”) govern access toand use of the StatBreak platform operated by StatBreak Pty Ltd (“StatBreak”,“we”, “us”, “our”).

By accessing or using the platform, you agreeto be bound by these Terms.

StatBreak is available only to individualsaged 18 years or older.

If you do not agree to these Terms, you must not use the platform.

2. Nature of the Service

StatBreak provides AI-assisted sportsanalytics and statistical insights.

The platform:

-Is for informational and analytical purposesonly
-Uses automated systems, including artificial intelligence, which may produceerrors, inaccuracies or incomplete results
-Does not provide financial, wagering, betting or investment advice
-Does not guarantee completeness, accuracy, reliability or suitability ofoutputs
-Users are solely responsible for how they interpret or rely on statisticaloutputs

Users acknowledge that outputs generated byartificial intelligence are probabilistic in nature and may vary.

3. Account Registration

To use certain features, you must create anaccount via:

-Google authentication; or
-Email and password.

You agree to:

-Provide accurate information
-Maintain account confidentiality
-Not share login credentials
-Maintain only one account unless authorised

StatBreak may suspend accounts suspected ofmisuse or duplication.

4. Subscriptions & Payment

Access to certain features may require a paidsubscription.

-Subscription tiers determine usage limits andfeature access
-Payments are processed by Stripe or equivalent provider
-StatBreak does not store credit card details
-Subscriptions may renew automatically where specified
-Refunds are provided only as required by Australian Consumer Law

StatBreak reserves the right to modifysubscription pricing or tiers with notice.

5. Fair Use & Usage Limits

StatBreak operates on AI infrastructure withvariable computational costs.

To maintain service integrity, StatBreak mayat its discretion:

-Impose daily, monthly or session-based querylimits
-Apply rate limiting
-Restrict or throttle excessive usage
-Suspend or terminate accounts engaging in disproportionate usage
-Modify fair use thresholds at any time

Paid subscriptions remain subject to fair usecontrols.

6. Prohibited Conduct

You must not:

-Use automated systems, bots or scripts toaccess the platform
-Scrape, extract, harvest or replicate data
-Reverse engineer the platform
-Circumvent usage limits
-Share account credentials
-Use the platform for unlawful purposes
-Attempt to interfere with security mechanisms

StatBreak may suspend or terminate accountsf or breach of this section.

7. Intellectual Property & Data Ownership

All intellectual property in the platform,including software, databases, AI models, analytics and derived insights, isowned by StatBreak.

Users retain ownership of their personalinformation.

StatBreak owns:

-Platform infrastructure and source code
-Aggregated analytics
-De-identified behavioural datasets
-Derived statistical models and AI-generated insights
-Commercial insights developed from anonymised data

Users receive a limited, non-transferable licence to use the platform for personal or internal business purposes only.

8. Data Commercialisation

StatBreak may:

-De-identify personal information
-Aggregate usage data
-Develop statistical reports
-Use aggregated insights for research or commercial purposes
-License anonymised datasets to third parties

StatBreak does not sell identifiable personal information.

9. Beta Terms

If the platform is designated as Beta:

-The service is provided “as is”
-Features may change without notice
-Performance may vary
-Data outputs may evolve
-Certain features may be limited or withdrawn

Users acknowledge that Beta participation mayinvolve system monitoring and performance evaluation.

10. Advertising

StatBreak may display advertising.

Advertising may be:

-Internal (StatBreak network); or
-Served via third-party advertising providers.

Advertising may be informed by platformengagement behaviour.

StatBreak does not endorse advertisers.

11. Suspension & Termination

StatBreak may suspend or terminate youraccount if you:

-Breach these Terms
-Violate fair use policies
-Engage in automated scraping
-Attempt to interfere with system operations

Users may terminate their account at any time.

12. Limitation of Liability

To the extent permitted by law:

-StatBreak is not liable for indirect orconsequential loss
-Liability is capped at the amount paid by the user in the preceding 12 months
-Nothing excludes rights under Australian Consumer Law

StatBreak is not responsible for decisions made based on statistical outputs.

13. Indemnity

You agree to indemnify StatBreak againstclaims arising from:

-Misuse of the platform
-Breach of these Terms
-Unlawful conduct

14. Enterprise & SDK Access

Any enterprise, SDK, white-label or API accesswill be governed under a separate written agreement.

These Terms do not grant rights to commercial redistribution or integration.

15. Governing Law

These Terms are governed by the laws ofVictoria, Australia.

The parties submit to the exclusive jurisdiction of the courts of Victoria.

16. Amendments

StatBreak may update these Terms from time totime.

Continued use constitutes acceptance ofupdated Terms.
